Murder-accused Pro-Secure boss Ferrel Govender is expected to appear in the Durban High Court on Tuesday morning.
He is expected to appeal against the refusal of his formal bail application.
The 40-year-old father of three was denied bail on February 3, 2025 in the Durban Magistrate's Court.
Govender has been charged with the murder of Shailen Singh who was gunned down in a parking lot in Umhlanga on December 29, 2024.
Ferrel and his brother Darren, 35, are accused of killing the 32-year-old over a love affair.
Singh is accused of having an affair with Ferrel's girlfriend.
Darren has been released on R200,000 bail with strict bail conditions.
Ferrel has been incarcerated since he handed himself over to Durban North SAPS on January 1,, 2025.
In his ruling, Magistrate Broughton said that Ferrel failed to provide exceptional circumstances.
The brothers were charged with a Schedule 6 offence, in which the State alleged that the murder was pre-meditated and the accused had to provide the court with exceptional circumstances as to why they should be released on bail.
In an explosive affidavit by lead investigator Warrant Officer Bob Pillay, he told the court that CCTV footage placed both brothers at the scene of the crime and that there was cellphone evidence between Ferrel and Singh minutes leading up to the murder.
Pillay further stated that Ferrel allegedly shot Singh 10 times.
The brothers have denied the allegations.
